Glance Deck — Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you" or "Customer") and GT Media, LLC, a Texas limited liability company ("GT Media", "we", "us", or "Company"), governing your purchase and use of the Glance Deck product, the website at glancedeck.com, the web-based firmware installer at flash.glancedeck.com (the "Web Installer"), the Glance Deck firmware and software (the "Software"), and any related documentation and services (collectively, the "Service").

BY PURCHASING, FLASHING, INSTALLING, OR USING THE SERVICE, OR BY CLICKING TO ACCEPT THESE TERMS, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT PURCHASE OR USE THE SERVICE.

Your use of the Software is also governed by the Glance Deck End User License Agreement (EULA), and your use of personal data by our Privacy Policy, each incorporated into these Terms by reference and available at glancedeck.com/legal.


1. Definitions

  • "Device" means a hardware unit running the Software, whether (a) an Assembled Device sold by GT Media pre-built with the Software installed, or (b) Customer Hardware — a compatible third-party board that you supply and onto which you install the Software yourself using the Web Installer ("DIY").
  • "License" means a Glance Deck software license, identified by a license key, that authorizes use of the Software on one Device, as further described in the EULA.
  • "Sensors" means the third-party wireless sensors you choose to monitor with the Service. GT Media does not manufacture, sell, or warrant Sensors.
  • "Beta Program" means the pre-release evaluation program described in the separate Beta Program Terms.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract. The Service is offered for personal, non-commercial recreational use (e.g., vans, RVs, boats, campers). The Service does not currently require an account; if we introduce accounts, additional terms may apply.

3. Orders, Pricing, Payment, and Shipping

3.1 Pricing. Prices for Assembled Devices and Licenses are as stated at the point of sale and are exclusive of taxes, duties, and shipping unless stated otherwise. We may change prices prospectively at any time.

3.2 Payment. Payments are processed by our third-party payment and checkout provider. We do not store full payment card numbers. You authorize the charge for the total shown at checkout.

3.3 Taxes. You are responsible for applicable sales, use, and similar taxes.

3.4 Shipping (Assembled Devices). Title and risk of loss for Assembled Devices pass to you upon delivery to the carrier. Delivery dates are estimates.

3.5 Returns and Refunds. Assembled Devices may be returned in original, undamaged condition within 30 days of delivery for a refund of the purchase price, less original and return shipping. Licenses and digital activations are non-refundable once a License has been activated or an activation token has been issued, because activation permanently binds the License to your Device. Statutory rights that cannot be excluded are unaffected.

3.6 Resale. Assembled Devices and Licenses are sold for end use, not for resale, sublicensing, or commercial redistribution, except under a written reseller agreement with GT Media.

4. License to Use the Software

The Software is licensed, not sold. Your right to use the Software is governed entirely by the EULA. Each License authorizes the Software on a single Device and is bound at activation to that Device's hardware identifier; it cannot be moved to, shared with, or used on another Device. Use of the Software without a valid License and a valid, unmodified activation token is not authorized and is a material breach of these Terms and the EULA.

5. DIY Flashing — Assumption of Risk (Customer Hardware)

THIS SECTION APPLIES IF YOU INSTALL THE SOFTWARE YOURSELF ONTO CUSTOMER HARDWARE USING THE WEB INSTALLER. READ IT CAREFULLY.

5.1 You own the hardware and the risk. The Web Installer writes firmware to hardware that you own and supply and that GT Media does not manufacture, control, sell, or test. Flashing firmware to an embedded device is an inherently risky operation.

5.2 You acknowledge and accept that:

  • (a) Flashing can render the hardware non-functional, unstable, or permanently inoperable ("bricked"), can corrupt or erase data and settings, and can damage attached components — and that this may be irreversible;
  • (b) The "Wipe Device" / full-erase function permanently and irreversibly destroys all firmware, the License token, and all settings on the connected hardware, including non-Glance-Deck firmware;
  • (c) You are solely responsible for selecting compatible hardware, putting the hardware into the correct mode, selecting the correct board/firmware, backing up anything you wish to keep, and verifying the result;
  • (d) Outcomes depend on your hardware, USB cabling, drivers, browser, and environment, all of which are outside GT Media's control;
  • (e) The Web Installer requires a compatible desktop browser (Web Serial) and may not work in all environments; and
  • (f) Flashing the Software may void the warranty offered by the manufacturer of your hardware.

5.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISK ARISING FROM USE OF THE WEB INSTALLER AND ANY DIY FLASHING, AND GT MEDIA HAS NO LIABILITY FOR ANY DAMAGE TO, LOSS OF, OR MALFUNCTION OF ANY HARDWARE, DATA, OR PROPERTY RESULTING FROM FLASHING, ERASING, OR ATTEMPTING TO INSTALL OR REMOVE THE SOFTWARE. This Section 5 does not apply to Assembled Devices, which are covered by the Limited Hardware Warranty in Section 7.

6. Safety Notice — Informational Use Only (IMPORTANT)

GLANCE DECK IS A CONVENIENCE AND INFORMATIONAL DISPLAY ONLY. IT IS NOT A SAFETY DEVICE, ALARM, OR LIFE-SAFETY SYSTEM, AND MUST NOT BE RELIED ON AS ONE.

  • Glance Deck displays readings broadcast by third-party Sensors. Those readings may be delayed, missing, inaccurate, out of range, stale, or unavailable for many reasons outside our control (sensor failure, depleted sensor batteries, wireless interference, range, environmental conditions, or Sensor firmware).
  • Do not rely on Glance Deck to detect or warn of any hazardous condition, including but not limited to propane/LP or other gas leaks, carbon monoxide, smoke or fire, battery overheating or failure, electrical faults, tank overfill, or water intrusion.
  • Glance Deck is not a substitute for, and does not replace, properly installed and maintained certified safety equipment such as propane/LP gas detectors, carbon monoxide detectors, smoke alarms, and manufacturer gauges and protection systems. Always follow the safety instructions of your vehicle, appliance, battery, and Sensor manufacturers.
  • You are solely responsible for safe operation of your vehicle, systems, and equipment, and for independently verifying any reading before relying on it. To the maximum extent permitted by law, GT Media is not liable for any injury, death, property damage, or loss arising from reliance on, or the absence, delay, or inaccuracy of, any reading displayed by the Service.

7. Limited Hardware Warranty (Assembled Devices Only)

7.1 GT Media warrants that an Assembled Device will be free from defects in materials and workmanship under normal use for one (1) year from the date of delivery (the "Warranty Period").

7.2 Exclusive remedy. If a valid warranty claim is made during the Warranty Period, GT Media will, at its option and as your sole and exclusive remedy, repair or replace the Assembled Device, or refund the price paid for it.

7.3 Exclusions. This warranty does not cover: Customer Hardware or any DIY installation; Sensors or other third-party products; damage from misuse, accident, water, modification, unauthorized repair, reflashing or tampering with the Software; normal wear; or cosmetic damage. Removing, modifying, or attempting to circumvent the Software or License voids this warranty.

7.4 How to claim. Contact support@glancedeck.com within the Warranty Period with proof of purchase and a description of the issue.

7.5 This Section 7 gives you specific legal rights; you may have other rights that vary by jurisdiction. Nothing in these Terms limits non-excludable statutory or consumer warranty rights.

8. Acceptable Use; Anti-Piracy and Anti-Circumvention

You agree that you will not, and will not permit or assist anyone to:

  • (a) copy, distribute, resell, rent, lease, sublicense, publish, or otherwise make the Software or any License key or activation token available to others;
  • (b) use the Software without a valid License, or use, share, or distribute a License key or activation token on or for more than the single Device to which it is bound;
  • (c) reverse engineer, decompile, disassemble, or attempt to derive source code or the license/cryptographic keys, except to the limited extent this restriction is prohibited by applicable law;
  • (d) modify, patch, tamper with, or create derivative works of the Software or firmware images, or run, distribute, or assist in distributing any modified, patched, "cracked," or unofficial build;
  • (e) circumvent, disable, bypass, defeat, or interfere with any license check, activation, device binding, integrity check, policy/revocation mechanism, or other technical protection measure in the Software, the Device, or the Web Installer, or develop, distribute, or use any tool or method to do so;
  • (f) remove or alter any proprietary notices; or
  • (g) use the Service in violation of law or to infringe the rights of others.

The Software contains technological measures that control access to and use of copyrighted works. You acknowledge that circumventing those measures, and trafficking in means to do so, may violate 17 U.S.C. § 1201 (DMCA) and other laws, and is a material breach of these Terms and the EULA. GT Media reserves all rights and remedies, including injunctive relief, statutory damages, and recovery of costs and attorneys' fees where available. Any License used in breach of this Section terminates automatically without refund.

9. Intellectual Property

The Service, the Software, the Glance Deck name and logo, and all related content are owned by GT Media or its licensors and are protected by intellectual property and other laws. Except for the limited rights expressly granted in the EULA, no rights are granted to you. The Software includes third-party open-source components licensed under their own terms; see the Open-Source and Third-Party Notices at glancedeck.com/legal. Nothing in these Terms limits your rights under those open-source licenses with respect to the components they cover.

10. Third-Party Sensors, Hardware, and Services

The Service interoperates with third-party Sensors, hardware, browsers, and hosting providers that GT Media does not control and does not warrant. Trademarks and product names of Sensors (e.g., third-party tank, battery, solar, and air- quality monitors) are the property of their respective owners; references are for compatibility identification only and do not imply endorsement or affiliation. Your use of third-party products is governed by those parties' terms.

11. Disclaimer of Warranties

EXCEPT FOR THE EXPRESS LIMITED HARDWARE WARRANTY IN SECTION 7, THE SERVICE, THE SOFTWARE, THE WEB INSTALLER, AND ALL RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GT MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, SECURE, OR THAT ANY READING WILL BE TIMELY OR CORRECT. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • (a) GT MEDIA, ITS MEMBERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR FOR PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • (b) GT MEDIA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID GT MEDIA FOR THE PRODUCT OR LICENSE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT, OR (ii) FIFTY U.S. DOLLARS ($50).
  • (c) THESE LIMITATIONS APPLY TO ALL CLAIMS, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND FORM AN ESSENTIAL BASIS OF THE BARGAIN.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Texas Deceptive Trade Practices–Consumer Protection Act.

13. Indemnification

You will defend, indemnify, and hold harmless GT Media and its members, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your misuse of the Service; (b) your DIY flashing or use of Customer Hardware; (c) your breach of these Terms, the EULA, or Section 8 (Anti-Piracy and Anti-Circumvention); or (d) your violation of law or the rights of any third party.

14. Term and Termination

These Terms apply while you use the Service. Your License and your rights under these Terms terminate automatically if you breach the EULA or Section 8. On termination, you must stop using and remove the Software. Sections that by their nature should survive (including 5, 6, 8–13, 15–17) survive termination.

15. Governing Law; Dispute Resolution; Arbitration; Class Waiver

15.1 Governing law. These Terms are governed by the laws of the State of Texas, and applicable U.S. federal law, without regard to conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

15.2 Informal resolution. Before filing a claim, you agree to contact support@glancedeck.com and attempt to resolve the dispute informally for at least 30 days.

15.3 Binding arbitration; class waiver. Except for (i) small-claims matters and (ii) claims for injunctive relief to protect intellectual property or to enforce Section 8, any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Dallas County, Texas. YOU AND GT MEDIA WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You may opt out of arbitration by emailing support@glancedeck.com within 30 days of first accepting these Terms.

15.4 Forum. For any matter not subject to arbitration, the state and federal courts located in Dallas County, Texas have exclusive jurisdiction, and you consent to that venue.

16. Changes to the Service and Terms

We may modify the Service or these Terms. The current version is always posted at glancedeck.com/legal with a "Last updated" date. Material changes will be indicated by updating that date and, where practicable, by reasonable notice. Continued use after changes take effect constitutes acceptance.

Devices. Devices do not automatically receive Terms updates. The version of these Terms in effect when you purchased or activated your License governs that Device; the most current version always governs the website, the Web Installer, and any new purchase or activation. We post the current version, and the relevant prior versions, at glancedeck.com/legal.

17. General

These Terms, the EULA, the Privacy Policy, and (if applicable) the Beta Program Terms are the entire agreement between you and GT Media regarding the Service and supersede prior agreements. If any provision is unenforceable, it will be limited or severed and the remainder will remain in effect. Our failure to enforce a provision is not a waiver.
