Glance Deck — End User License Agreement (EULA)

This End User License Agreement ("EULA") is a binding agreement between you ("you" or "Licensee") and GT Media, LLC, a Texas limited liability company ("GT Media"), governing the Glance Deck firmware and software, including all components, updates, and accompanying documentation (the "Software"). The Software is licensed, not sold. This EULA is incorporated into and forms part of the Glance Deck Terms of Service.
BY ACTIVATING, FLASHING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO THIS EULA. IF YOU DO NOT AGREE, DO NOT ACTIVATE, FLASH, INSTALL, OR USE THE SOFTWARE.
1. License Grant
Subject to your continuous compliance with this EULA and the Terms of Service, and conditioned on a valid License and a valid, GT Media-issued, unmodified activation token, GT Media grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one (1) copy of the Software in object-code form, on the single Device to which your License is bound, solely for your own personal, non-commercial use to view sensor information.
2. License Binding (One License, One Device)
At activation, your License is cryptographically bound to one Device's hardware identifier and a signed activation token is issued for that Device only. A License, once bound, cannot be moved, transferred, shared, resold, or reused on any other Device, and an activation token is valid only on the Device it was issued for. This one-license-per-device design is a core term of this EULA, not merely a technical artifact.
3. Restrictions
You will not, and will not permit or assist anyone to:
- use the Software without a valid License and valid activation token, or on more than the one bound Device;
- copy (except one backup as permitted by non-excludable law), distribute, sell, rent, lease, lend, host, sublicense, or otherwise transfer or make the Software, any License key, or any activation token available to any third party;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, signing keys, or cryptographic material from the Software, except, and only to the extent, this restriction cannot be excluded under applicable law;
- modify, adapt, translate, patch, tamper with, or create derivative works of the Software or any firmware image, or build, run, distribute, promote, or assist in distributing any modified, patched, "cracked," keygen'd, or unofficial version;
- circumvent, disable, bypass, defeat, or interfere with any licensing, activation, device-binding, integrity-verification, anti-tamper, or policy/revocation mechanism, or any other technological protection measure, in the Software, the Device, or the Web Installer, or create, distribute, or use any device, tool, service, or method primarily designed for that purpose;
- extract, reuse, or redistribute any signed token, key material, or firmware region; or
- remove, obscure, or alter any copyright, trademark, license, or other proprietary notice.
4. Technological Protection Measures; DMCA
The Software employs technological measures that control access to and use of copyrighted works owned by GT Media. Circumventing those measures, or manufacturing, importing, offering, or trafficking in technologies, products, or services to do so, is prohibited and may violate the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 1201, and other applicable laws. GT Media expressly reserves all rights and remedies available under copyright, anti-circumvention, trade-secret, contract, and other law, including injunctive relief, actual and statutory damages, and recovery of costs and attorneys' fees where available.
5. Ownership
The Software is licensed, not sold. GT Media and its licensors retain all right, title, and interest in and to the Software and all intellectual property rights therein. No title or ownership is transferred. All rights not expressly granted are reserved. You acquire no rights in GT Media's trademarks or branding.
6. Open-Source Components
The Software includes third-party open-source components that are licensed to you under their own license terms, which are listed in the Open-Source and Third-Party Notices at glancedeck.com/legal. To the extent any open-source license grants you rights that conflict with this EULA with respect to that component, the open-source license controls for that component only. This EULA does not limit, and is not intended to limit, any rights you have under those open-source licenses (including any right to obtain, modify, or relink LGPL-licensed components as described in the Notices). The remaining proprietary Software remains governed by this EULA.
7. Updates
GT Media may, but is not obligated to, make updates available. The Device does not automatically download updates and does not contact GT Media for licensing; you choose whether to install an update by re-flashing via the Web Installer. Updates are part of the "Software" and are governed by this EULA, and may change or remove features (including for security, compliance, or license-policy reasons).
8. Revocation and Termination
This EULA and your License terminate automatically, without notice, if you breach Section 2, 3, or 4. GT Media may also revoke a License (for example, for fraud, chargeback, or distribution of a leaked key) by refusing future activations, and may invalidate non-compliant tokens through a firmware license- policy update. On termination you must immediately cease using and remove the Software. No refund is owed for a License terminated for breach. Sections 3–6, 8, and 9–11 survive termination.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GT MEDIA DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. Glance Deck is an informational display only and is not a safety device; see Section 6 (Safety Notice) of the Terms of Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GT MEDIA'S LIABILITY ARISING OUT OF OR RELATED TO THE SOFTWARE IS SUBJECT TO THE DISCLAIMERS, EXCLUSIONS, AND CAPS SET OUT IN THE TERMS OF SERVICE (SECTIONS 11–12), WHICH ARE INCORPORATED HERE BY REFERENCE.
11. U.S. Government End Users; Export
The Software is "commercial computer software" provided with restricted rights; U.S. Government use is subject to this EULA. You will comply with all applicable export-control and sanctions laws and will not export or use the Software in violation of them.
12. General
This EULA is governed by the laws of the State of Texas and is subject to the dispute-resolution, arbitration, class-waiver, severability, and general provisions of the Terms of Service, which apply to this EULA as if set out here. If there is a conflict between this EULA and the Terms of Service regarding the Software, this EULA controls for the Software.
